Terms of Use

1. The eshop.ingenic.gr is the official online store for the sale of food supplements and medical devices to the consumer, created and operated by the Company under the name "Prime Biosciences PC" and the distinctive title "Prime Biosciences", located at Lemesou 18, 17341, Agios Dimitrios, Attica, with VAT number 801230512 and Greek General Commercial Registry Number 152269401000 (hereinafter the "Online Store").

2. The access and use of the website eshop.ingenic.gr is free of charge to the user. The cost of access and use of the telecommunications network is borne by the user according to the terms and conditions established by the network provider and the user's telecommunications provider.

3. The use of this website must be used exclusively for lawful purposes and in a manner that does not prevent its use by third parties. The visitor/user is obliged to use it in accordance with the law, morality and these Terms and not to engage in acts or omissions that may cause damage or malfunction in this (website), or affect or endanger the provision of services by eshop.ingenic.gr through it.

4. This website and the services offered through it are addressed exclusively to adults. It is prohibited for minors to use or visit it, as well as to enter into transactions. The eshop.ingenic.gr bears no responsibility whatsoever for any visit to this website and its use by minors, since it cannot control the identity of incoming users/visitors.

5. The eshop.ingenic.gr tries to maintain and ensure the availability of the website and its content. Regardless of these efforts, the availability of this website depends on various factors such as the technical equipment of the users, the number of users trying to connect simultaneously to this website or to the Internet, etc.

6. The terms of use and operation of this website apply in conjunction with the Privacy Policy, Cookies Policy, Shipping Methods, Payment Methods and Product Returns and regulate the respective issues of sales, returns, payment, use of the website, personal data protection and privacy assurance and the use of cookies and management of visitors' choices and preferences, where applicable in particular.

7. The Company reserves the right to modify freely, unilaterally and without notice the terms of use and operation of this website and in general, the terms of transactions with the online store within the framework of the law. The mere posting on this website is sufficient for any new term to enter into force, or modification or cancellation of an existing term, without prejudice to the orders already confirmed by the Company. Visitors/users must check periodically if there have been any modifications to these terms. The mere posting of terms on this website and in any other place on the website, fulfils the requirements of informing users of any changes to the terms.

8. The use of this website and the services provided on it presupposes and confirms the acceptance by the user of the pre-existing terms, as they apply, with the above-mentioned indicatively described modifications, interventions and removals by the Company. Any invalidity of some of the terms (use - operation of the website and transactions), does not result in the invalidity of the rest.

9. If you do not agree, in whole or in part, with these Terms, you must refrain from visiting and using the Online Store. In any case, in order to complete your orders, it is necessary for you to expressly accept the Terms, which you indicate by selecting the relevant field.

Intellectual Property Rights

1. The entire content and services of eshop.ingenic.gr are the intellectual property of Prime Biosciences PC (Lemesou 18, 17341, Agios Dimitrios, Attica) and are protected by Greek, EU and international legislation on intellectual property. All the content of the e-shop that have been or will be introduced on the Internet, including the distinctive titles, trademarks, images, graphics, photographs, drawings, texts, etc. are the intellectual property of the Company and are protected by the relevant provisions of Greek law, European law and international conventions.

2. Any copying, reproduction and retransmission of the material is strictly prohibited without the written permission of the Company, and is available to visitors of the site only for personal use (non-profit or commercial).

3. The names, images, logos and distinctive features that represent the online store eshop.ingenic.gr or third parties and their products or services are exclusive trademarks of eshop.ingenic.gr or third parties protected by the relevant trademark laws. Their appearance on the website should in no way be construed as a transfer or assignment of a license or right to use them.

Terms of Sale

1. The online store eshop.ingenic.gr allows purchases through the "buy as a visitor" function. This way of purchase requires to fill in only the necessary data for processing your order.

2. Delivery of orders is possible only to consumers or companies with a delivery address within Greece.

3. For the shipment of your order, the payment of the total amount including product costs, shipping costs and other costs (e.g. bank charges) must be completed with one of the available payment methods. No cash on delivery is possible.

Order Submission Procedure

1. To submit an order, you must, after logging into your account, accurately fill in all required fields in the special order form and click on "Approve Payment". If all fields are not completed, you cannot proceed to the next steps of the order. In the last step before the final submission of the order, a preview of your order becomes available.

2. After submitting the order, an e-mail is sent by the Company confirming the registration of your order. The above email does not mean that your order has been accepted. Your orders are subject to acceptance by the Company.

3. At the same time, the "Order Confirmation" is also made in writing through the management platform of the Online Store, in the data you have entered during your order. The "Order Confirmation" describes in a binding manner the terms of sale and purchase set out therein, namely the products sold, the quantities, the price and the total cost of the products, the cost of transport and the chosen method of payment.

4. The dispatch of the order by the Company is only possible after you have paid the total cost of the order, including the cost of products, transport costs and other costs (e.g. bank charges), and the Company has confirmed the completion of the payment in full. There is no possibility of cash on delivery.

Shipping Methods

1. Shipping to your place by Courier

α). Courier shipments are carried out throughout Greece through "Tachydema AE". Deliveries of orders by courier are made during working days and hours. The delivery time of orders within Attica is 1-3 working days (excluding sales periods and public holidays) from the next working day of receipt of each order, once the order has been paid in full. For orders outside of Attica, the delivery time may vary depending on the location (e.g. inaccessible areas). If for any reason we are unable to meet the expected delivery date, we will inform you accordingly.

b). Courier delivery costs are 3.50€/shipment for orders of weight or volumetric weight up to 2 kg. For orders over 2 kg, there is an additional charge of 1.50€ for each additional kilo.

c). For deliveries within and outside Attica, no shipping costs will be charged when the final order value, including any discounts, is equal to or exceeds 30€, while deliveries with a final order value, including any discounts, of less than 30€ will incur shipping costs, which will be borne by you and will be communicated to you upon submission of the order. Additional weight or volumetric weight charges of more than 2 kg apply to orders over 30€.

d). The delivery of your order is made to the postal address you have indicated with your order. The Company shall not be liable for failure to deliver an order in the event that no actual address has been declared or the address declared does not exist or the person designated as the recipient of the order does not exist at that address.

e). The Company is not responsible for any delay in the delivery of your order, which is not due to its fault or due to force majeure or due to circumstances that are beyond the normal daily business activity.

f). Upon receipt of the order, you must check whether it includes all the products in your order, as it may have been finally formed.

g). The order is deemed to have been delivered when you or a third party designated by you, other than the carrier, has obtained possession of the products, as evidenced by the signing of the acknowledgement of receipt of the order at the agreed delivery address. From the moment of delivery of your order and its receipt, you bear sole responsibility for the products.

h). If any problem arises with the delivery of your order, the carrier (courier) will contact you at the contact details you have provided. If you are not at the delivery point at the time of delivery, you will either receive a call from the courier or the courier will leave you a note explaining what you need to do to collect your order. If after 15 days from the time your order is available for delivery by the courier company it is still not delivered for reasons due to your fault, we will consider that the contract between us has been terminated and we will refund any payment we have received from you, deducting from the payment the amount of five  (5) Euros in order to cover the administrative costs incurred.

2. Collection with BOX NOW

a). BOX NOW as a method of collection at check out allows you to collect your package yourself at any time you wish at one of the BOX NOW Locker Automatic Collection Machines. The delivery time for orders within Attica ranges from 1-3 working days (excluding sales periods and public holidays) from the next working day of receipt of the respective order, once the order has been paid in full. For orders outside Attica, the time period may vary depending on the location (e.g. inaccessible areas).

b). Your order will be collected at the BOX NOW Locker Automatic Collection Machine that you have selected when placing your order. The Company is not responsible for the inability to deliver in the event that a real email address or mobile phone number has not been declared. Also, the Company is not responsible for the availability of the BOX NOW Lockers Automatic Collection Machines.

c). Your package will wait for you at the BOX NOW box for 48 hours. You can easily and quickly extend the delivery time for another 24 hours via the website https://track.boxnow.gr/ or by calling to 211-1005301.

d). The shipping cost with BOX NOW is 2.50€/shipment for orders with a weight or volumetric weight of up to 8 kg and dimensions of up to 17 x 45 x 60 cm.

e). For deliveries within and outside Attica, you are not charged shipping costs when the final value of the order, including any discounts, is equal to or exceeds 30€, while deliveries with a final order value, including any discounts, of less than 30€ incur shipping costs, which are borne by you and are notified to you when submitting the order.

f). The Company is not responsible for any delay in the delivery of your order, which is not due to its fault or due to force majeure or due to circumstances that are beyond the normal daily business activity.

g). Upon receipt of the order, you must check whether it includes all the products in your order, as it may have been finally formed.

h). The order is deemed to have been delivered when you or a third party designated by you, other than the carrier, has acquired possession of the products, as evidenced by the entry of the collection code in the BOX NOW Locker Automatic Collection Machine. From the moment your order is delivered and received, you are solely responsible for the products.

i). If any problem arises with the delivery of your order, you will be informed by BOX NOW at the contact details you have provided. If you do not receive your order within 48 hours or 72 hours (in case of a request for an extension for another 24 hours) from the moment you are informed that your order is ready for collection from the BOX NOW Locker, we will consider that the contract between us has been terminated and we will refund any payment we have received from you, deducting from the payment the amount of five (5) Euros in order to cover the administrative costs incurred.

Prices

1. The prices listed in the Online Store include VAT. The prices do not include any transportation costs, if any.

2. The Company reserves the right to change the listed prices at its discretion without prior notice. Any changes in product prices do not affect orders that have already been submitted.

3. Your billing is based on the prices that were in effect and were posted in the Online Store on the date and time of submission of the order (with the exception of the case of an obvious error as provided below), even if they have changed after the date of submission of the order.

4. Every effort is made to ensure that all prices on the website are accurate, however, errors may occur, even after we have accepted the order. If we find an error in the price of any product in your order, we will inform you as soon as possible. In this case you will have the option to either cancel your order or reconfirm the order at the corrected price.

5. Refunds for items purchased under a promotional program/action will be based on the price at which they have been purchased.

Payment Methods

1. All payments to the Company will be made in Euros (€).

2. Payment is possible using credit, debit and prepaid cards (Visa, Mastercard, Maestro, Diners, Discover), by bank deposit or via IRIS. Specifically:

a). Payments by card

All payments made using a card are processed through the electronic payment platform "Nexi XPay" of Nexi Payments Greece S.A. and uses TLS 1.2 encryption with a 128-bit encryption protocol (Secure Sockets Layer - SSL). Encryption is a way of encoding information until it reaches its intended recipient, who will be able to decode it using the appropriate key. All necessary technical measures have been taken to secure the transaction, the Company does not retain your card details in any form and bears no responsibility in the event that your network or computer has fallen victim to malicious activity. Also, the Company bears no responsibility if your card issuer does not approve or delays approving the payment. Payments are accepted via credit, debit and prepaid cards of Visa, Mastercard, Maestro, Diners and Discover.

b). Bank deposit

If you choose to pay by deposit to a bank account, you must deposit the amount of money corresponding to the value of your order (plus shipping costs if any) within 3 working days of submitting your order into one of the following bank accounts, which are held at the respective bank, citing the order number and your full name:

Only after the payment has been received, the Company will proceed with the acceptance and shipment of your order. If the payment is not made within the above period, the order will be considered cancelled.

c). IRIS payments

To make the payment for your order via IRIS, you can use the company's VAT number (VAT number: 801230512) or scan the QR Code that you will find in the Payment Methods section.

3. Upon sending the order, the Company will issue a receipt or invoice, which it will provide you in printed and/or electronic form.

4. In the case of bank deposit, to avoid errors, you should indicate the order number and your full name in the reason for the deposit.

5. For bank deposits made by banks other than Alpha Bank, Piraeus and National Bank, the bank cost of transferring the money is borne by the buyer. Therefore, in the charges, you must choose that the bank costs will be borne by you or add the additional amount charged by your bank to the total cost of the order.

6. In case of cancellation of an order that has not been dispatched, any payments will be refunded in full without undue delay, in the same way that your payment was made. For cancellation of an order that has been dispatched for shipment, then you will bear a cancellation cost of five (5) € and will be deducted from the refund amount.

Products

1. The Company ensures that there are, to the extent possible, accurate and up-to-date photographs and descriptions of the products. Points that depict the date of manufacture/packaging, expiration or other indications that change are those that were in effect at the time the photograph was taken and may have changed. The Company is committed to the accuracy, truth and completeness of the information provided in the online store, both with regard to the identity of the company and the transactions provided through the online store. The Company, in the context of good faith, is not responsible and is not committed for errors due to an error during the registration of electronic data in the store.

2. The photographs of the products as well as their description are based on the information we receive from the companies/official representatives each time and are indicative. The product photo and information may not fully correspond to each product, due to different availability per region and eshop.ingenic.gr bears no responsibility for this.

3. The products sold have the usual shelf life based on applicable legislation and transactional ethics.

4. The Company guarantees that the products available through the Online Store are safe, suitable for consumption and comply with hygiene and safety rules at all stages of their production, storage and transportation.

5. The Company, within the framework of its transactions from the online store eshop.ingenic.gr, is not liable for further damages that may arise from the execution or non-execution of orders or from the delay in execution, for any reason. The online store with the trademark eshop.ingenic.gr cannot provide any guarantee for the availability of products, but undertakes to promptly inform customers of unavailability. The online store provides the content (information, names, photos, illustrations), the products and services available through the website “as is”. Under no circumstances is the Company liable civilly or criminally for any damage (positive, special or consequential, which indicatively and not limitingly, alternatively and/or cumulatively consists of loss of profits, data, lost profits, financial satisfaction, etc.) that a visitor to the online store or a third party may suffer due to a reason related to the operation or non-operation and/or use of the website and/or the inability to provide services and/or products and/or information available through it and/or from any unauthorized interventions by third parties in products and/or services and/or information available through it.

Product Returns

1. You may return a product within (14) fourteen calendar days from the date of receipt. Products must be returned in the condition received by the customer, complete, undamaged and in their packaging, accompanied by all documents and original purchase receipts. In the event that the return is not made within the above period or does not meet any of the following requirements, eshop.ingenic.gr may not accept any return and replacement.

The cases in which returns are accepted are the following:

  • Product that has exceeded the expiration date, with proven fault of eshop.ingenic.gr.
  • Sale of the wrong product, with proven fault of eshop.ingenic.gr.
  • Shipping of a product of poor or defective quality, with proven fault of eshop.ingenic.gr.

2. Before returning any product, you must contact eshop.ingenic.gr by phone or email, in order to determine the suitability of the product for return and to prevent unnecessary transfers. Contact can be made either by phone at (+30) 211 1828611 or by email at info@ingenic.gr.

 

ATTENTION: Product returns without prior communication and approval from our company will not be accepted.

 

3. Sending a photo, both of the product packaging and of the external shipping packaging, is mandatory in order to prove the fault of eshop.ingenic.gr.

4. In case of an accepted return of products, our Company will contact you to inform you in more detail about the available return methods and the procedure.

5. The product will be checked and if the conditions are met and the return of the product is accepted, the consumer is entitled to receive a credit note of equal value for the purchase of other product(s).

6. In the event that the product does not meet the return conditions, the customer may receive the same product again at his own expense.

7. In the event that an invoice has been issued for the shipment of the products, then the return shipment must carry a shipping note.

8. Return Costs

a). In the event of eshop.ingenic.gr's fault, the cost of the return shall be borne by eshop.ingenic.gr and the customer shall receive a credit note of equal value. Otherwise, the cost of the return shall be borne by the customer and shall amount to five (5) Euros in order to cover the administrative costs incurred.

b). Furthermore, in the event that the product you ordered, while presented as available, is sold out during the period between the order and the receipt of the order by our staff, then eshop.ingenic.gr must contact you within a reasonable period of time to arrange the progress of your order, which will include either a refund or a change of the ordered item.

c). The eshop.ingenic.gr reserves the right to abolish or amend its returns policy, by publishing the relevant new terms and conditions on its website. In case of repeated returns or in case eshop.ingenic.gr, in its absolute discretion, considers that the customer is abusing the right of return or acting in bad faith, it reserves the right to refuse the return of the product, even if the above terms and conditions are met. In case the product violates the terms of returns and is deemed unsuitable for return, then it will be returned to the customer and the shipping costs will be borne by the customer.

9. Product Return Procedure & Methods

a). Before any product return, you must contact eshop.ingenic.gr by phone or email, in order to determine the suitability of the product for return and to prevent unnecessary transportation. Contact can be made either by phone at (+30) 211 1828611 or by email at info@ingenic.gr.

b). Product returns can be made through the courier company “Tachydema AE” or through BOX NOW. In case of an accepted return of products, our company will contact you to inform you in more detail about the available return methods and the procedure.

 

ATTENTION: Product returns without prior communication and approval from our company will not be accepted.

 

10. Cancellation and Modification of Order

a). After acceptance of the order by the Company, you have the right to cancel or modify your order by completing the Contact Form, which you will find in the online store in the CONTACT category, by sending an email to info@ingenic.com or by calling +30 211 1828611. The cancellation or modification of your order can be made in whole or in part, without penalty up to the point at which it has not been dispatched for shipment. If you wish to cancel an order that has been dispatched for shipment, then you bear a cancellation cost of five (5) Euros in order to cover the administrative costs incurred.

b). Any force majeure event gives the Company the right, even after acceptance of the order, without penalty, to cancel the order or postpone the execution or delivery at its absolute discretion, after informing you in writing or by telephone.

c). In the event that any of the ordered products are not available on the day of execution of the order, the Company will inform you in a timely manner of the delay and the new delivery date. In this case, you will have the right to claim the replacement of the unavailable products with other corresponding products of equal value, the partial execution of your order or to withdraw from the contract.

11. Final Terms of Returns

a). The eshop.ingenic.gr reserves the right to refuse a product return if, in the Company's absolute discretion, the customer abuses the right to return products, e.g. in the case of repeated return requests.

b). The eshop.ingenic.gr reserves the right to repeal or amend this returns policy, by posting the relevant new terms and conditions on its website.

c). Visitors are kindly requested to refer to the applicable terms in order to be informed of any amendments before initiating the product return process.

Applicable Law

These Terms & Conditions are governed by and construed in accordance with Greek Law. For any dispute arising between the parties, the competent courts for the resolution of the dispute will be the Courts of Athens.Online Dispute Resolution

Electronic Dispute Resolution

The Online Store is fully harmonized with the procedure for the out-of-court resolution of domestic and cross-border disputes in relation to the sales contracts drawn up with each of its users/customers, as described in KYA 70330/2015. Therefore, you are entitled to seek settlement of your consumer dispute with us through the online out-of-court dispute resolution platform available at http://ec.europa.eu/consumers/odr/.
